TERMS AND CONDITIONS OF TRADE These terms of trade apply to your purchase of products from Crystal Clear Wellbeing NZ Ltd (referred to in these terms of trade as “we” “us” or “our”), whether ordered via our website, by email or written correspondence, or by phone. Please review the following terms and conditions which govern the purchase of products from us. By ordering or purchasing our products, or accessing, browsing or using our website, you acknowledge that you have read, understand and agree to be bound by these terms.

  1. Orders and Deliveries
    When we receive an order we will validate the order and confirm via email that it has been received and is being processed. If you have any queries or problems regarding your order, please contact us with your order number and we will sort things out for you as soon as possible. We aim to deliver all products within 3 to 5 working days of us confirming receipt of the order. This is an estimate only and may be subject to delays beyond our control. If we are not able to supply the products or there is likely to be a significant delay in making delivery (e.g. because the product is out of stock or the delivery is to a rural/remote location), we will notify you as soon as reasonably possible, in which case you may cancel the order and you will receive a refund (including the applicable delivery charges). We will not otherwise be liable to you for any damages, costs or expenses of any kind, suffered or incurred by you due to the order not being fulfilled or the products not being delivered within the anticipated delivery time. Delivery will be made by a courier of our choice. Courier fees will be included on your invoice. Deliveries to rural areas and the outer islands (Chatham Island, Stewart Island, Kawau Island, Waiheke Island, Matakana Island, Great Barrier Island and d’Urville Island) will incur additional delivery costs.
  2. Invoicing and Payment
    We will invoice you when your orders are dispatched. Unless otherwise agreed with us, you are required to pay your invoices in full to our nominated bank account within 7 working days of the date of the invoice. Account holders are required to pay their account in full to our nominated bank account on or before the 20th of the following month. We reserve the right to suspend the use of your account until all monies owing are received in full, and to charge any legal fees or collection costs incurred in recovering the full amount.
  3. Currencies
    All products are priced in New Zealand Dollars (NZD).
  4. Risk
    The risk of any loss of, or damage to, the products will pass on to you on delivery.
  5. Returns and Exchanges
    Products will only be accepted for exchange or refund if we have made an error in supplying an item, and if you contact us within 14 days from the date the products are delivered. Returns or exchanges are not permitted under any other circumstances. We will supply you with a PDF courier ticket which you can print out and tape to the return box. Once this has been completed and you let us know it's ready for collection, we will arrange the courier.
  6. Cancellation
    To cancel an order please call us on 021 116 2554 during business hours within 12 hours of your purchase, quoting your order number, to see whether your order has been processed. Please note that you will remain liable for full payment of the price of the purchased item(s) and the delivery fee should you fail to provide a cancellation notice within 12 hours of your order being placed, or if your order has already been despatched before you contact us.
  7. Privacy and Security
    When you apply for a credit account you are granting us permission to store your personal information. We will only use personal information about you for the following reasons:
    • To create an account for you
    • To record and process your orders
    • To add to our database so we may inform you of specials, promotions, offers and events via email or post
    • To respond to your queries
    • Any other reasons which we may notify at the time information is collected
    Disclosure
    We may share your personal information:
    • Where the disclosure is in connection with one of the purposes for which the information was collected (e.g. to courier companies to enable deliveries)
    • Where we are required or authorised by law to make disclosure
    Except as provided above, we will not share your personal information with any third party.
    Correct Information
    We will take all reasonable measures to ensure that personal information held by us is accurate and up to date. You are entitled to know as to whether or not we hold personal information about you and you are entitled to reasonable access to this information. You may also request: 
    • That we correct this information if it is inaccurate
    • That your details do not appear on our database.
    • You can make changes to your personal information by contacting us.
  8. Website use Intellectual Property Rights All intellectual property, including without limitation any trademarks, text, graphics and copyright, is owned by us or our content suppliers. We are the exclusive owner of all rights in the compilation, design and layout of the website. Right to Use Website and Content You may use our website only for the purposes for which it is provided. You must not use the site for fraudulent or other unlawful activity or otherwise do anything to damage or disrupt this site. Content We endeavour to ensure that any content will be current, accurate and complete when you access it. However we reserve the right to vary our prices from time to time. Any error or inaccuracy which is brought to our intention will be dealt with within a reasonable time.
  9. Liability To the extent permitted by law: We will not be liable for any damages, losses, or expenses, or indirect losses or consequential damages of any kind, suffered or incurred by you in connection with your use or purchase of our products. If your use of our products is subject to New Zealand’s Consumer Guarantees Act 1993, you may have rights or remedies which are not excluded nor limited by the above. If you purchase our products for the purpose of a business as defined in the Consumer Guarantees Act 1993 then the application of that Act is excluded. Force Majeure We will not be responsible for any delay or failure to comply with our obligation under these terms of trade if the delay or failure arises from any cause which was beyond our reasonable control. This does not affect your statutory rights.
  10. Amendments We may amend these terms of trade from time to time, and if we do so we will give you 14 days’ notice. Any notices will be sent to your last known email address. By continuing to operate your account after any such amendment you are deemed to have agreed with the amended terms.
  11. Jurisdiction and Governing Law These terms of trade and any matters or disputes connected with them will be governed by New Zealand laws and will be dealt with in New Zealand courts.
